The body corporate bylaws refer to the set of rules governing the internal management of those lots. The bylaws may specify rules relating to noise, parking, behaviour of guests, pets, garbage disposal and the use of common property. The bylaws are sometimes referred to as a Community Management Statement.Tenancy Agreement TermWhich tenancy agreement term should I use?LawDepot allows you to choose from 2 main types of tenancy agreement terms.Fixed End Date - A tenancy agreement with a fixed end date gives certainty of term for both the landlord and the tenant. It specifies the exact day the tenancy will end. The advantage here is that neither party has to give notice to terminate the tenancy agreement, it simply ends on the specified date. During a fixed term tenancy agreement the landlord cannot increase the rent, or change any other terms of the tenancy agreement unless he specifically reserves the right in the agreement, and the tenant agrees to the changes .Periodic - A periodic tenancy will continue so long as neither party wishes to terminate the tenancy agreement. To terminate the tenancy agreement the landlord and tenant must give notice of their intention to leave as specified by statute. A landlord can raise the rent, or change the terms of the tenancy agreement in these types of agreements by providing proper notice as required by statute. At the end of the notice period the tenant must move out or the landlord can abflug eviction proceedings against them.What happens when a tenant tries to terminate a fixed term tenancy?Typically when a tenant agrees to a fixed term tenancy, usually for either 6 months or 1 year, the tenant is agreeing to be responsible for the rent for that period of time. If the tenant vacates the premises prior to the end of the term of the agreement, the tenant will typically still be responsible for payment of rent for the entire length of the lease (provided the tenancy is not in a jurisdiction that allo ws the tenant to give notice to prematurely end a fixed term tenancy). Typically, if the Landlord is able to re-rent the premises prior to the end of the lease of the breaching tenant, the breaching tenant is no longer required to pay rent as the landlord cannot collect double rent for the premises.In addition, some leases may contain penalty clauses whereby the tenant is required to pay re-rental fees to cover part of the cost of the landlord having to re-rent the premises. However, the amount of the re-rental fee has to be reasonable and must be a pre-estimate of the damages that the Landlord will suffer in having to re-rent the premises early.What happens when the tenancy agreement term expires?The expiry of the tenancy agreement does not necessarily terminate the rental arrangement. If a Periodic term is selected, the tenancy agreement will automatically renew based on the same terms as the first tenancy agreement, unless it is varied by giving proper notice as required by statu te. So a Periodic monthly tenancy agreement that continues for one year is actually 12 separate, automatically renewing tenancy agreements. The tenancy agreement will continue to renew automatically until one of the parties wishes to terminate the tenancy agreement (by giving proper notice as required by statute).If a Fixed term is selected, the leasing relationship may still continue after expiry if both the landlord and the tenant wish it to. In some jurisdictions, statute dictates that it will become a Periodic term tenancy agreement, usually of the month-to-month variety, though this may vary. In other jurisdictions, the Fixed term tenancy agreement may become a tenancy at will or a tenancy at sufferance when it expires, which lasts only as long as both parties wish it to, and is not subject to as much legal protection as a Periodic tenancy agreement. If you wish to terminate all rights under a Fixed term tenancy agreement as soon as the tenancy agreement expires, you must serve proper notice before the end of the tenancy agreement term, in accordance with local statute.RentCan the landlord increase rent?For fixed term tenancies, landlords can only increase rent if they have provided specific terms in the tenancy agreement allowing for rent increases. In any case, the landlord can only increase once in any 6 month period. The landlord must provide the tenant with at least 60 days written notice before increasing the rent.NoticeHow much notice do I need to give to terminate a tenancy?In most jurisdictions, there is a minimum period of notice required by statute. The tenancy agreement can specify a notice period longer than the legal minimum, but it cannot specify a period shorter than the legal minimum. If it does, the legal minimum notice will still be required. You should consult the governing statute for these legal minimums as they will vary according to jurisdiction and the type and length of the tenancy agreement. What is notice to enter?A landlord us ually does not have the right to enter a rented apartment suite unless there is an emergency, for example a fire or gas leak, or unless the landlord gives the tenant proper notice as defined by statute. So long as the proper notice is given, a tenant cannot refuse entry to a landlord. What should I do if I do not want to renew my tenancy agreement?You must provide proper notice to the landlord that you do not intend to renew the tenancy agreement, before the tenancy agreement expires. Notice must be given a certain amount of time before the tenancy agreement expires, as dictated by statute in your jurisdiction. This amount of time is called the notice period. Typically, the notice period is one month for leases with a term of one month or less, and two or three months for leases with a term of more than one month, but this will vary according to the jurisdiction. You should consult the governing statute for the jurisdiction the property is located in to find out the required notice period for your tenancy agreement. What is the minimum amount of notice to be given when terminating a tenancy?For periodic tenancies, the tenant must provide the landlord with at least 21 days written notice before terminating a tenancy. However, if each period in the tenancy term is longer than 21 days, then the tenant must provide the landlord with written notice equivalent to a single period.If the tenant has a fixed tenancy and wishes to leave at the end of the fixed period, the tenant does not have to provide the landlord with written notice.Bond and DepositsWhat is a bond/security deposit?A bond/security deposit is a sum of money the tenant pays to the landlord to guarantee that the tenant will fulfill all obligations under the tenancy agreement. The landlord holds the security deposit in trust for the term of the tenancy agreement to ensure that the tenant does not default on the terms of the tenancy agreement or otherwise damage the property. Should the tenant damage the pr operty (normal wear and tear excluded) or if the Tenant has not paid rent, the landlord is entitled to recover the amount owing from the security deposit. Usually the tenant must provide the landlord with the security deposit at the start of the tenancy agreement term. At the end of the tenancy agreement term, the tenant will receive the deposit back minus any deductions for repairs/restoration.Please note in some jurisdictions, a landlord is not allowed to ask for a security deposit. In other jurisdictions, a landlord may require both a security deposit and other types of deposits (for example, a pet damage deposit). You should review the governing legislation for the location of the property to make sure the type of deposit is allowable. What is the maximum amount of bond/security deposit?In South Australia, the maximum bond equals four weeks rent if the rent is less than $250/week. If the rent exceeds $250/week the landlord/agent can ask for a bond equaling six weeks rent. A rece ipt showing the date, the persons name, the amount and the address of the premises must be issued within 48 hours after the bond is paid. All security bonds must be paid to the Residential Tenancies entdeckung using the Bond Lodgement form within seven days (or in the case of registered land agents, within 30 days) of receipt. When can the landlord deduct from the bond/security deposit?The landlord can deduct from the bond/security deposit when the tenancy ends and the tenant owes the landlord money for either unpaid rent or damage to the premises. Inspection SheetWhat is an inspection sheet?Prior to moving in, the tenant and the landlord should walk through the premises and write down any existing damage. This written account is called an inspection sheet. The landlord and tenant should both get a copy of this report. It is also a good idea to take photographs or a video of the condition of the premises. This will assist in interpretation of the an inspection sheet if there is a dispute at the end of the tenancy.In some jurisdictions, an inspection sheet is also required upon moving out, as a condition for the landlord to make a claim against the tenants security deposit/bond.Why do I need an inspection sheet?An inspection sheet will help to prove what damage was caused by the tenant for purposes of deducting the amount to fix the damage from the bond. What needs to be considered when filling out an inspection sheet?The following should be considered when filling out an inspection sheet At the start of the tenancy the landlord must provide the tenant with 2 signed inspection sheets. The inspection sheets should include a comprehensive lis t of the condition of all the contents in the premises (including fixtures, furniture and appliances) at the start of the tenancy. The tenant must sign both sheets and return 1 of the copies to the landlord. The inspection sheet should be kept in a safe place. The inspection sheet provides evidence of the condition of the premises at the start of the tenancy and it may help resolve any dispute which may arise.MiscellaneousWhat is an assignment and how does it differ from a sublease?Assignments and subleases both occur when the tenant gives his/her rights under the tenancy agreement to a third party. A sublease or an assignment typically requires the consent of the landlord. An assignment occurs when the tenant gives to a third party all of his or her remaining rights under a tenancy agreement for the entire term of the tenancy agreement. If a tenant assigns property and the landlord consents to the assignment, that tenant no longer has any rights to the property nor any obligations to the landlord. In a sublease the tenant can transfer a portion of the leased space (e.g. a room in a house) or a portion of the tenancy (e.g. for 5 of the remaining 6 months of the tenancy agreement) to a third party. The original tenant retains whatever rights under the tenancy agreement he or she has that were not transferred to the third party, and also retains most of his or her obligations under the tenancy agreement. The original tenant can still sue and be sued by the landlord for lease violations. What are signing incentives?Signing incentives are bonuses the landlord gives to the tenant, typically for either signing a tenancy agreement or signing a fixed term tenancy agreement. They may include free months rent, or a rent decrease for the months of the fixed term tenancy. If the tenant breaches the tenancy agreement, these incentives may have to be paid back to the landlord. Why do tenants need insurance? Doesnt the landlord already have it?While the landlord typically h as insurance, it usually covers only the landlords assets and liabilities. I booked the Power Week!’’ Everyone was super excited and screamed ‘’Yeeeah’’! Only I was a bit confused but I managed to get some answers right away.I moved to Bulgaria 3 months ago, after living 6 years in England where I studied and worked in Marketing and Customer Service. I came here with one goal. To start working for a company with a great culture and with a product I was inspired by and I believed in. A place where I could learn about all areas of marketing and be allowed to develop my skills and talents in areas I’m best at.I came across and created my résumé on their platform. I immediately saw the difference between my old and new résumé and I thought to myself ‘’I’d love to work with these guys!’’ I managed to grab their attention and joined the team two months ago. I have to say that I already feel like I really belong here. It is not only because everyon e is so talented, helpful and easy-going. It’s mainly because they included me in all events and activities they do together from the very first day. (My first day was a Monday morning and I was invited to come for breakfast! We continue this tradition to this day.)But let’s get back to the awesome Power Week.So what is the Power Week?The Power Week is a new concept initiated by a Bulgarian Startup one year ago and has not been properly explained yet. Independently, the two words are pretty clear. But contrary to popular impressions, the Power Week is not a team building event, nor a week filled with hard work and no play. It is actually a perfectly balanced combination of both. The main objective of the Power Week is to move your whole team into nature. To get connected with it, energized by it.It is not enough to have a very cool office designed in a way that helps the team’s productivity. You need a change of the surroundings and the scenery, in order to be more productive . The team lives together for the whole week. To me, this brought a whole new level of integrity and motivation. It also brought new ideas to our company and product.I am convinced that it’s the best method for being a more productive team, brainstorming new ideas, setting new goals for the future and becoming a more successful business, regardless of what stage it’s at.Where/When to organize the Power Week?At , we chose the beginning of September when the weather’s still warm and everybody was present at work. Generally, we all enjoy the warm weather and the sunshine, therefore it was an easy choice for us!When it comes to where*, *this year our company chose a housing complex in a small village, just about 15 kilometers away from one of Bulgaria’s most beautiful mountains â€" Rhodope. It was perfectly suitable for our team of 10. All we needed was a bed to sleep in, good Internet connection, a big enough room where we could fit together with all of our equipment (computers , speakers, whiteboards, etc.) and most importantly, beautiful nature as far as an eye can see.The bonus was a swimming pool, the owner’s friendly dog Arthur and a big garden with a BBQ shed. We gathered there every evening to eat together, play games and talk about life. Generally, I got to know each team member better and learned their story. We became better friends and I know I can trust them more now.What did we do during the Power Week?Some of the activities we planned beforehand but some of them happened spontaneously. For example a lip-sync battle, where one pretends to sing while the music’s playing loudly. It was amazing to see everyone getting into the character of a particular singer, dance like them and act like them. It was the night I laughed the most!Other night we cooked pasta together and discovered that one of our developers is an amazing chef! (He promised to cook his Carbonara in the office too!) Our conversations during the evenings included topics like ‘ ’Your most embarrassing moment’’, ‘’What would you do if you were named a CEO of our company’’ and others similar to these.During the day we played pool volleyball to freshen up. We also drove ATV’s to get the adrenalin going. We climbed the ancient Thracian city of Perperikon, learned about its impressive history and enjoyed stunning views of Rhodope. Every morning we practiced Yoga, I never thought it could be so energizing!The one thing, however, that I’ve experienced for the very first time was meetings by the pool and in the garden. Everyone could have a drink and feel free to speak whatever came to their mind. (Topic related, of course.) During those meetings, we came up with many new ideas, improvements and possible future projects. It was amazing to hear everyone’s point of view and endless creativity in some. Once in the summer and once in the winter.This one, however, was my first and I must say that it not only helped deepen our company culture and values. It also got the critical creative ideas flowing thanks to th e change of setting and break out of the routine. The environment simply helped bring the best in every team member. It created a space where all departments can be under one roof together and inspire each other with new ideas for the core business itself, the product, design and marketing efforts.Most importantly, it helped erase any possible groupthink that has formed over time and thus brought missed opportunities to light. Believe it or not, we’ve accomplished much more during the Power Week than in any other regular week! It is exactly because of the perfect balance between fun and work. That is something you can’t achieve in a traditional working environment.As I attended a Power Week already, I know that it has the potential to greatly increase the quality of the relationships inside your company and not only that. In order to list them all, I would probably need a second lengthy blog post. The most important ones, though are: employees get to know each other better and b ecome closer to each other. This will make them collaborate more efficiently and reduce friction in the workplace.You will, in general, get more work done. Many of your colleagues or employees will step out of their comfort zone to overcome things that were holding them back before.Each person in the team will discover a new side to each other as well as themselves, they didn’t realize was there before. Finally, you will create so many new memories which you can always come back to and cherish as a team.Generally, the Power Week promotes a flatter and leaner structure with less hierarchy. This, in turn, results in equity and a sense of achievement amongst your team. As I said, the positives are countless. Growing a Solar Recycling Non-Profit Growing a Solar Recycling Non-Profit Solar modules that were installed in the early 1990s, with expected lifetimes of 25 years, wont reach the end of their useful life until 2015 or later. Currently, very low volumes of solar modules are recycled. PV Cycle, a European nonprofit organization founded in 2007, is organizing a voluntary recycling program. It would like to be the organization responsible for coordinating the pickup and recycling of waste from all modules in Europe that have reached the end of their useful life, whether due to damage, guarantee/warranty issues, or simple discarding. So far, it is. Since starting operations with six founding member companies and two member associations in 2007, membership has soared to include 90% of the eligible PV module manufacturers, importers, and resellers or rebranders who purchase modules in other countries and sell in Europe. Membership at the beginning of 2011 was 123, with 74 new member companies added in 2010 alone. PV Cycle is growing its business along two parallel paths, one operationally and one legislatively. Early Growth Through Membership The program is voluntary. Manufacturers opt to participate as members. Annual membership fees in 2010 from full members were 5,000-25,000 Euros depending on the size of the manufacturers European revenue: 5,000 Euros for wholesalers, distributors, project developers, system integrators, installation contractors, and cell manufacturers at an associate level without voting rights, and 1,000 Euros is for associations and research institutes. Jan Clyncke, PV Cycles Managing Director, says that they have been able to operate to date solely with membership fees. Success Laying Logistical Foundations PV Cycle has created a free-of-charge take back program for anyone disposing of modules that have been in service. Simply call PV Cycle and they transport the modules for recycling. Their first stop is at permanent collection bins at collection sites. When the bins are full or large PV installations are being decommissioned, PV Cycle will transport larger truckloads to suitable recycling plants for recycling, where modules are separated and recycled into raw materials. As of the beginning of 2011, PV Cycle has deployed recycling bins and set up 183 collection sites. It has transported around 80 tons of discarded modules, and is in the process of developing, qualifying, and testing multiple recycler options for the wide variety of waste expected. Representing Member Companies There is currently no explicit requirement in the European Union that PV manufacturers must recycle their own waste, at least not yet. PV Cycle wants to expand its network so that 85% of all modules in Europe are recycled using its plan. The organization created an Environmental Plan in 2009 that was signed by 85% of its members and submitted it to the European Union in 2010 for consideration. Clyncke explains that PV Cycle wants exclusion from any draft legislation that is on the table now, and he is confident that the collective, voluntary plan they have proposed would be more cost-effective than 27 separate member countries each implementing their own programs with their own rates, standards, timing, and costs. As the raw materials of photovoltaic waste will be covered in additional European initiatives, PV Cycle hopes to grow to represent 100% of the possible manufacturers by continuing to be their legislative voice. SWOT and Whats Ahead for PV Cycle Clyncke views the huge membership rate of 90% as the organizations strength, saying it gives them credibility and a unified voice. The main weakness is that current recycling costs at low volumes are very high; it is a challenge waiting for high volumes of waste and the cost benefits they bring. He believes opportunities for recycling solar modules will skyrocket as the industry continues to grow, and believes that Europe is the right place to lead this initiative as the worlds largest PV region. The biggest threat to PV Cycle, according to Clyncke, is related to the difficult legislation challenge ahead. If the specific needs of the producers are not taken into account when recycling programs are legislated, It will create enormous costs for the PV industry. PV Cycle is continuing to serve its customer base, locating more collection sites, drop-off locations, transport contractors, recycling contractors, improving their communications, and finalizing their monitoring committee. The organization is also working out an updated funding strategy to be released this June. This will be a small business to watch as PV recycling approaches its prime.
